F.I.R.E. Going After Campus Speech NAZI's Wallets?


I have posted previously concerning The Foundation for Individual Rights in Education (F.I.R.E.), an organization I have been following for some years now, as they are among the few entities out there who are putting up a viable fight to see that the 1st Amendment rights of the students of our nation's institutions of higher learning are upheld.

Their successes have been many, yet even so, many university and college administrators/professors still seem to believe they can trample all over the rights of their student expressing themselves in the form of "speech codes," intimidation, threats, and other PC nonsense - and can do so with no personal financial risk to themselves.

Thanks to the efforts of F.I.R.E., that may be about to change:

PHILADELPHIA, December 22, 2010—Today, the Foundation for Individual Rights in Education (FIRE) warned the presidents and top lawyers at nearly 300 public colleges and universities across the nation that they and their staff should be ready to pay out of their own pockets if they continue to violate their students' free speech rights.

"For too long, public college administrators have been intentionally violating the free speech rights of their students, secure in the knowledge that they won't personally lose a dime should a court rule against them," said FIRE Senior Vice President Robert Shibley. "This has given administrators the opportunity to censor whatever opinions they dislike and make all of us pay for it. But thanks in large part to FIRE, the excuse that makes this possible—that they 'didn't know' that students had free speech rights—is quickly vanishing."

FIRE is putting them on notice by sending a certified mailing this week to the presidents and general counsel of 296 of the biggest and most prestigious public colleges across the nation, highlighting significant legal developments from the past year. FIRE's mailing warns these top administrators that with the state of the law on campus speech codes clearer now than ever before, they and their employees violate the speech rights of students at their own financial peril, as they can no longer count on "qualified immunity" to shield them from liability.

Administrators should also be aware of a recent federal case in Georgia coordinated by FIRE, in which a federal district court determined that former Valdosta State University president Ronald Zaccari was not shielded from personal liability for violating the clearly established rights of student Hayden Barnes. (Zaccari is currently appealing that decision.) This is a major finding against a former university president, and if upheld, it will serve as important federal precedent for holding future administrative malefactors personally responsible for their abuses of student rights.

It's about bloody time.

Funny how libs are always so generous when it comes to spending other people's money, but when it comes to their own, the weld their wallets shut tighter than Fort Knox.

Maybe now that the possibility of being held personally liable for defecating all over the rights of their students will cause at least a few of them to pause and consider the consequences of their blatantly illegal actions before implementing them.

I'll be keeping an eye on this latest development.

Who knows? Perhaps freedom of expression will survive in the last places you would ever consider it threatened.

Philly Mayor Saves Christmas!


Okay, that may be overstating things a bit - well maybe a lot, but even though this is a very small victory for our side in an overall much larger War on Christmas, a victory it still is.

Christmas is back.

Mayor Nutter, after sustaining two days of controversy, wants "Christmas" back up on the signs at the entrance to the German Christmas Village at City Hall. Nutter told PhillyClout he spoke with the village organizer and the sign should be back up by tomorrow.

Nutter said the decision came after "personal reflection" on the matter.

"We are an international, multi-ethnic, multi-faith city," Nutter said. "I took some time to step back from all of this to think about it in a larger context.

It's too bad that in a supposedly free country we who know the true "reason for the season" are constantly subjected to the PC whims of a bunch of Christ, Christian and Christmas-hating bigots, who somehow have developed the belief that they posses the "right" to impose their bigotry on us by restricting our 1st Amendment rights.

What I have found so distressing about all this is the Christian community's tepid response to these assaults on our freedoms. It's time to grow a spine, start throwing this stuff back in their faces and tell them to get lost if they don't like it.

One thing I have been doing for years is that, every time I get the PC "Happy Holidays" greeting, I respond with, "Merry Christmas to you, too." I have often gotten some strange looks in return, and a few people appeared somewhat offended by my reply, but so what?

Just exactly where in the Constitution of the United States does it say people have a right not to be offended?

And if someone is truly offended by anything related to Christmas (and what sort of a miserable, self-hating wretch does one have to be in order to be offended here, anyway), perhaps they would feel more comfortable living in somebody else's country.

Like North Korea.

If you'll pop for the one-way ticket, I'll happily drive them to the airport - for free.

Tea Party Crashers

Well, you just knew it had to happen. A bunch of stinking, freedom-hating, communist supporters of the Comrade Chairman have put up a website dedicated to the 'destruction' of the Tea Party movement.

Apparently, their plan is to infiltrate Tea Party events and do anything they can to try and make those attending look bad in the eyes of the American people.

What is truly funny is these Obama boot-licking commie goobers claim to have the support of a lot of republicans and independents.

Right.

Just how many repubs and independents do you know who support Obama's turning this nation toward communism?

Yeah, me, neither.

As one who is involved heavily in the Tea Party movement, I can tell you first hand these "crashers" do not know what they are talking about. I have met a large number of Tea Party goers and supporters, and they are about as middle of the road as you can possibly get - a very good cross-section of our society, who have become alarmed at the crushing debt we are now saddling on future generations, our seemingly out-of-control federal government, and the economy and job-killing taxes on the horizon.

I have yet to meet even one that matches, or even comes close to matching, what these "crashers" are trying to portray us as.

I know many of you will be attending Tea Party and other similar events on or around April 15th.

Keep you eyes peeled for these communist saboteurs.

A Notepad Mea Culpa Regarding the A.C.L.U.

I have to admit that I am not a real big fan of the A.C.L.U. I understand what they claim to be, but they have always seemed to me somewhat biased and selective when it comes to speaking out in defense of certain individuals or groups. My sense has always been, with a few notable exceptions, they tend to lean a little too far to the left for my comfort, but that is not to say they don't get it right on occasion.

Back on February 10th, I posted this article about the feds and police spying on pro-lifers in Wisconsin, and in which I wrote the following:
I doubt we will hear so much as a peep out of the A.C.L.U., either. Of course, we all know if George W. Bush were still in the White House and the feds were investigating, say, C.A.I.R., the people at the ACLU, among other lefty-oriented organizations, would be spinning on their eyebrows and spitting nails over it.
Apparently I was a little hasty in condemning the ACLU for its "lack of action" in this matter, as this comment was posted by Chris Ahmuty of the ACLU of Wisconsin:

The link provided by Mr. Ahmuty lead to this Wisconsin State Journal story:
It concluded the report was unlikely to "have any impact on civil liberties or civil rights" given its limited dissemination. But anti-abortion groups and the American Civil Liberties Union of Wisconsin on Monday both criticized the federal government's collection of information on law-abiding protesters.
You will find the whole story here.

I hope the attention this matter has generated will cause the DHS, and other law enforcement agencies, to consider their actions carefully the next time around. After all, our federal government has, in a sense, acquired the power of life and death over us, and power of that nature needs to be watched closely. Very closely.

-And it matters not whether the people running said government have a "D" or and "R" behind their names.

I also hope the scrutiny will result in those responsible for this hideous incident to be called on the carpet, but that is probably asking a bit much given the current environment in D.C.

DHS & Police Illegally Investigate Pro-Lifers in Wisconsin

Madison, WI (LifeNews.com) -- The Department of Homeland Security admitted today that it improperly conducted a threat assessment on pro-life and pro-abortion groups in Wisconsin. The assessment came before an expected rally last year in response to the University of Wisconsin Hospital board decided to allow abortions.

In February 2009, pro-life advocates planned to protest the hospital's decision to open up a new Madison Surgery Center doing abortions.

The Associated Press reported today that the department said in a memo that it "destroyed all of the copies of the assessment after an internal review found it violated intelligence gathering guidelines about 'protest groups which posed no threat to homeland security.'"

AP indicated the assessment was reportedly only shared with the director of Wisconsin's intelligence-sharing center and local police in Middleton, Wisconsin, the site of the rally.

Today, a pro-life organization in Wisconsin informed LifeNews.com of its concerns.

In response to an open records request by the Alliance Defense Fund and Pro-Life Wisconsin, the Middleton Police Department and the Wisconsin Department of Justice, along with the Department of Homeland Security all refused on February 4 to release copies of the threat assessment.

Pro-Life Wisconsin officials told LifeNews.com that the assessment was "inappropriately shared" and should never have targeted pro-life groups.

“The majority of Americans identify themselves as pro-life, and the Middleton Police Department has shown they are out of touch with this peaceful majority,” said Peggy Hamill, state director of the pro-life group. “Pro-lifers are not a minority of the population, nor are they second-class citizens. We refuse to let our First Amendment rights be silenced.”

A few months later in 2009, the Department of Homeland Security’s Office for Civil Rights concluded the investigation was an improper use of department resources.

The conclusion said the department inappropriately directed against activities protected by the First Amendment, in which law enforcement inappropriately engaged in “the collection, retention and dissemination of U.S. person information regarding protest groups which posed no threat to homeland security and… violated [DHS] Guidelines.”

Hamill said DHS destroyed its copies of the report, but the Middleton Police Department retained its copy.

In January 2010 the Alliance Defense Fund, on behalf of Wisconsin pro-life advocates, asked the Middleton Police Department for a copy of the report pursuant to Wisconsin’s open records laws.

The Middleton Police Department refused to disclose the report and further said that the DOJ similarly refused to authorize disclosure of the report, despite the fact that DHS had already determined that the report was an improper investigation of freedom of speech activities.

“This move by DHS illustrates the Obama administration’s goal of silencing pro-lifers. It is disturbing that a local police department has apparently tapped into the security apparatus of the federal government to potentially obstruct free speech,” Hamill concluded.

“Last year, DHS Secretary Janet Napolitano unjustly included pro-lifers in a report on domestic terrorism, and here we see her words in action," she said.

If we were living in a sane world, my hope would be that heads were going to ultimately roll over this travesty, particularly that of Janet "Reno II" Napolitano, but I shan't hold my breath waiting for it to happen, as the Holder "Justice" Department has shown itself to be somewhat, a'hem, lax in enforcing the law when it involves those they support.

Clearly we are dealing with a rogue administration that considers itself immune from constitutional scrutiny of any kind, and is not above using federal and local law enforcement agencies to try and intimidate those who actively, or even passively, oppose the hideous policies of the Obamanistas.

It does not get any more hideous than wantonly murdering unborn children, or supporting those that do.

Given Obama's actions during the campaign in attempting to use the courts to silence his detractors, this should surprise no one. It most definitely does not surprise me.

Not even a little bit.

Government Skools: Recruiting Ground for the Far Left

I have long held the belief that government schools exist solely for the purpose of aiding in the growth and broadening the scope of government. These so-called "schools" work toward this goal in two ways - educating children just enough to be marginally employable, and indoctrinating them to believe that government can solve all of their problems.

The last thing government wants is to have true independent thinkers running around. After all, people who can think, as well as do for themselves, don't need government in their lives, and are often hostile to government intrusion into them.

That, of course, just cannot be allowed, as we all know government knows what is best for us.

But it runs much deeper than that, as Barack Hussein Obama is now tapping government schools to supply his far-left crusade with willing recruits to promote his freedom-destroying agenda:

An Atlas reader, Chuck, has a student in the eleventh grade in an Ohio High School. Her government class passed out this propaganda recruiting paper so students could sign up as interns for Obama's Organizing for America (OFA is the former mybarackobama.com site.)

Obama is using our public school system to recruit for his Alinsky-inspired private army. Organizing for America is (and I quote) recruiting in our high schools to "build on the movement that elected President Obama by empowering students across the country to help us bring about our agenda" ............of national socialism.

The Ohio High School is Perry Local in Massillon, Ohio.

This is incredible. And evil. Suffer the little children -- enlisted like SS youth. This is no accident. Obama is poisoning our public school system. He acts as if it's his own private breeding farm. Once again academic learning and achievement is hopelessly abandoned, and supplanted by radical leftist activism from the leftwing Alinsky indoctrinators in the perversepublic school system.

Children must be advised to expose this ugly propaganda. Children must tell their parents how they are being used and manipulated. Parents, warn your kids. Better yet, home school.

Of course, this lunacy is absurd in the extreme, and should in no way be tolerated by a society that truly values its freedom. And that brings up a question many seem to be afraid to ask these days: Do the American people really still value their freedom?

I was once perhaps naive enough to believe we did, but given my observations over the last twelve months regarding Obama's rapidly unfolding Marxist nightmare, and the maddening (to me, anyway) complacency being displayed by the bulk of the American people, I am no-longer convinced that we do.

The Approaching Financial Train Wreck

In such a calamity, Caesar would be the lesser of two evils. The American Republic and Constitution would join earlier democracies in the ashbin of history.

If You Oppose Obama, Then You Must Be A Racist

I have been trying hard to ignore the cries of RACISM! that have been emanating from our friends on the left of late, and which are aimed at those of us opposed to the hideous, nation-destroying policies of Barack Hussein Obama. I understand why they are doing it, as they have run out of ways to defend the rapidly failing presidency of the former ACORN lawyer and community agitator, and are now reduced to scraping the bottom of their arsenal barrel in a desperate effort to try and save it for him.

Now they have gone out and dug up our 39th POTUS, affectionately known in my circles as Jihad Jimmy, and who proudly wears his antisemitism on his sleeve, to join them in hurling this ridiculous charge in a pathetic attempt to intimidate us pale-faces into silence:


What I find puzzling about the remarks of my former governor is they are coming from someone who is essentially occupying the 43rd spot on the POTUS totem pole. Why would he want to come to the aid of a man that is on a pace to possibly knock him up a notch?

This latest scheme by the left and their dog-washers in the State Controlled Media (SCM) to paint opponents of Obama as racists will ultimately backfire on them, just as their boycott of Glenn Beck and their attack on Rep. Joe Wilson did.

What is truly sad about this latest lefty lunacy is that it could very well damage race relations to a point that may take decades to repair. Isn't it strange how those who claim to support "racial harmony" are the first to fan the flames of racial division every chance they get?

Back when I was researching Obama, it quickly became apparent that he was no "uniter," but was, in fact, a divider. This prompted me to post on several Internet sites that, if elected, Obama could well set race relations in this nation back two decades.

I may have been wrong, as it appears he could set them back far further.

How unfortunate for America.

Yet Another Attack On Free Speech By "Tolerant" Liberal College Administrators

One of my major pet peeves is the advent of so-called "speech codes" that have sprung up all across America on the campus' of our nation's so-called institutions of "higher learning." As I have previously noted here at the Notepad, I myself was victimized by this hideous assault on freedom of speech when I was attending college nearly twenty years ago. Of course, I made no bones about my plan to deal with it directly, and the administrator who first thought I was going to cower into a corner and whimper like a baby, was caught completely off guard by my firm, yet polite response.

In the years since, this lunacy has grown far worse, to the point where many of our nation's college and university students have found themselves dragged before some form of disciplinary panel or other to receive punishment for their alleged transgression, or worse yet, expelled from the institution they were attending, simply due to the fact that something they said or penned merely offended someone.

Thankfully, several organizations have sprung up over the years to deal with the rise in speech fascism carried out by the spineless, and most often, liberal hypocrites who claim to support the idea of free expression-sure they do, right up until that expression rubs up against their decidedly left-of-center views, then the witch hunt begins in earnest.

The Foundation for Individual Rights in Education (F.I.R.E) is one of the organizations that stands up for the 1st Amendment rights of college and university students all across America. A recent California case that required their involvement caught my attention.

Tim Wilde was once a student at UCLA's Graduate School of Education, but was drummed out of the program for reasons he felt were due to his ideological views. As such, Mr. Wilde set up a web site that was critical of the University. This did not sit well with the powers-that-be at UCLA, who sent a letter to Mr. Wilde, demanding that he take down the site, using the rather flimsy assertion that his site constituted "trademark infringement and dilution" due to its use of "ucla" in the domain name, and went on to infer that Mr. Wilde might be committing a "criminal offense" under California law.

F.I.R.E. promptly sent a letter to the gowned gaggle at UCLA, pretty much calling BS on their assertions, and then went public with the story. Within hours of that, the school backed down.

Glad to see that, once again, a student, albeit a former one, was able to assert their freedom of speech/expression as guaranteed by the Constitution of the United States.

I just think it sad that organizations such as F.I.R.E are even necessary in a supposedly free country.

I Shed No Tears for the American Mengele

What follows is a slightly edited version of something I posted elsewhere earlier today:

As a libertarian, I believe very strongly that all human beings have the God-given right to life, liberty, and the pursuit of happiness. That especially includes those who exist, but who are not yet born into this world, and cannot speak for themselves.

This nation, under the bogus guise of “human rights,” and (let’s be honest here) as a matter of shallow, selfish convenience, has deprived that right to over 40 million of its own citizens. Any nation that would willingly commit genocide at that level, against its very own citizens, has a profoundly corrupt soul.

As I see it, there are only two acceptable reasons for taking the life of another human being. One is in defense of oneself, one’s family or some other innocent person. The other is in a time of war. Any other time, barring a tragic accident, is murder.

I realize that there are times when terminating a human pregnancy is necessary, but what Tiller was doing was outright infanticide. It matters not if the birth mothers were depressed.

Big deal. I get depressed sometimes, to, but I don’t go out and kill an innocent child over it.

As I see it, Tiller’s “profession” was in no way different than what Joseph Mengele was doing in Germany in the 1930s and 40s. Many in Germany supported what Mengele was doing, and sadly, far many more here in America support what Tiller did.

How does that make us any better than the NAZIs, or the Japanese, for that matter, who were themselves conducting hideous medical experiments on the Chinese?

Yes, what Roeder did was wrong, very wrong, but as we said back in the ‘90s, shit happens. The law provides a mechanism to deal with these situations, and it will do so here.

At the end of the day, it changes nothing. Abortion is still murder. It’s as simple as that. The fact that it may be legal matters not at all, and I am not interested in hearing whatever lies those who support this hideous procedure have conjured up to convince themselves that it is okay to take the lives of unborn human beings.

Remember, the NAZIs carried out over 11 million "post-natal" abortions. We executed a lot of those who participated in the slaughter after the war.

We currently live in a devolving, sick, twisted society-one in which we who support the right to life for our fellow human beings, and who happen to love our country, and revere its founding document, are considered extremists, if not outright terrorists, by not only our own government, but perhaps even a majority of our fellow citizens.

I honestly do not believe this society, or this nation, has much time left.

In what time we do have left, I’ll be damned if I am going to allow myself to be coerced, or otherwise intimidated into silence on any issue, and if Barack Hussein Obama, the SCM*, and the DHS don’t like it?

Tough.

BTW, I was adopted at the age of four weeks in 1964. I was lucky. Had I been a little later coming along, I very well could have wound up like this.

Its Not Your Mother's Girl Scouts Anymore

Think the Girls Scouts of the USA is a good, safe place to park your young daughter to keep her out of the insanity of the current culture war? Think again while you take a look at what the daughters of our nation are now going to be exposed to in this organization (bolds are mine):

In "Amaze: The Twists and Turns of Getting Along," girls from the sixth to the eighth grade will read a quote from Buddha and be encouraged to explore mazes and stone or dirt labyrinths – symbols rooted in pagan mythology and popular within the New Age movement as meditation tools.

They will be briefly introduced to Polish poet Anna Swir, known for her feminist and erotic poems, and Jane Addams, an ardent feminist and pacifist who received a Nobel Peace Prize.

The text features a quote from Harriet Woods, former president of the National Women's Political Caucus – a bipartisan group that endorses pro-abortion female candidates who run for public office.

As your daughter gets into higher age groups, particularly her junior and senior high school years, it gets even worse, as some of the "roll models" they will be introduced to are:

Elizabeth Gurley Flynn: labor leader, activist, feminist, founding member of ACLU and chairwoman of the American Communist Party

Luisa Moreno: labor leader, social activist, member of the Communist Party, married to delegate of the Socialist Party of America

Simone de Beauvoir: existentialist, French author of feminist books including "The Second Sex," key player in France's women's liberation movement

Rigoberta Menchu: Guatemalan activist and Nobel Peace Prize winner who joined Marxist guerrilla movement

The Girl Scouts should be the one place our nation's daughter's are safe from indoctrination by the freedom-hating Marxist left.

God knows they get enough of that from attending government schools.

I have to admit that I love some of the cookies the Girl Scouts sell, but I will have to seriously re-evaluate whether or not I will be buying them in the future.
